These Terms of Use apply to the Breath U mobile application (“Breath U” or the “App”). Breath U is a product of Interproperties B.V., Hoorn, the Netherlands, registered with the Dutch Chamber of Commerce under number 34237697 (“we”, “us”).

1. Licence

Breath U is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). Interproperties B.V. is the licensor. If anything in these Terms conflicts with the Standard EULA, the Standard EULA prevails.

2. Free features

The breathing and cold timers, Box Breathing, the Physiological Sigh, Oxygen Reset, the Cold Guide and Ripple are free, with no account and no limits. We may change the free set in future versions, but features you have paid for stay unlocked.

3. Breath U Premium

Premium unlocks all breathing techniques, all cold challenges, all Mindful Play experiences and everything we add in future updates. Premium is sold through Apple’s In-App Purchase system in two forms:

• Premium Yearly — an auto-renewable subscription. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for one year at the price shown in the App Store at the time of purchase, unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it at any time in your Apple Account settings (Settings → Apple Account → Subscriptions). No refund is given for the unused part of a period.
• Premium Lifetime — a one-time purchase that unlocks Premium for as long as Breath U is available on the App Store, on every device signed in with the same Apple Account.

Prices are shown in the App and in the App Store in your local currency and may change for new purchases. A launch price applies to purchases made during the launch period only. Use Restore purchases on the Premium screen to unlock Premium on a new or reset device.

4. Refunds

Purchases are processed by Apple. Refund requests go through Apple at reportaproblem.apple.com, under Apple’s refund policy. We cannot issue refunds ourselves.

5. Not medical advice

Breath U offers guided breathing, breath-hold and cold-exposure exercises for general wellbeing. It is not a medical device and does not provide medical advice, diagnosis or treatment. Retention breathing and cold exposure carry real risks. Never practise breath holds in or near water, while driving or standing, or in any situation where fainting could cause harm. If you have a heart, lung or blood-pressure condition, epilepsy, are pregnant, or are unsure about your health, talk to your doctor first. You use the App at your own risk and within your own limits.

6. Age

Breath U is intended for adults. You must be at least 16 years old to use the App.

7. Your data

Breath U has no account. Your sessions, challenges and badges stay on your device. How we handle information, including Apple Health data and purchases, is described in our Privacy Policy.

8. Acceptable use

You may use Breath U for personal, non-commercial purposes. You may not copy, modify, reverse-engineer or redistribute the App or its content except as permitted by law or the Standard EULA.

9. Availability and changes

We may update, change or discontinue features of the App. We aim to keep Breath U available but cannot guarantee uninterrupted operation. To the extent permitted by law, our liability is limited to the amount you paid for Premium in the twelve months before the claim.

10. Governing law

These Terms are governed by Dutch law. Disputes are brought before the competent court in the Netherlands, without prejudice to mandatory consumer protection in your country of residence.

11. Changes to these Terms

We may update these Terms when Breath U changes or when the law requires it. The latest version always shows its effective date at the top of this page.

Gebruiksvoorwaarden

Deze gebruiksvoorwaarden gelden voor de mobiele applicatie Breath U (“Breath U” of de “App”). Breath U is een product van Interproperties B.V., Hoorn, ingeschreven bij de Kamer van Koophandel onder nummer 34237697 (“wij”, “ons”).

1. Licentie

Breath U wordt aan je in licentie gegeven, niet verkocht, onder Apple’s Licensed Application End User License Agreement (de “Standaard-EULA”). Interproperties B.V. is de licentiegever. Bij strijdigheid tussen deze voorwaarden en de Standaard-EULA gaat de Standaard-EULA voor.

2. Gratis functies

De adem- en koudetimers, Box Breathing, de Physiological Sigh, Oxygen Reset, de Cold Guide en Ripple zijn gratis, zonder account en zonder limiet. We kunnen de gratis set in toekomstige versies wijzigen, maar functies waarvoor je hebt betaald blijven ontgrendeld.

3. Breath U Premium

Premium ontgrendelt alle ademtechnieken, alle koude-uitdagingen, alle Mindful Play-ervaringen en alles wat we in toekomstige updates toevoegen. Premium wordt verkocht via Apple’s In-App Purchase-systeem, in twee vormen:

• Premium Yearly — een automatisch verlengend abonnement. Het bedrag wordt bij bevestiging van de aankoop afgeschreven van je Apple-account. Het abonnement wordt automatisch met een jaar verlengd tegen de prijs die op het moment van aankoop in de App Store staat, tenzij je minimaal 24 uur vóór het einde van de lopende periode opzegt. Je beheert of beëindigt het abonnement in je Apple-accountinstellingen (Instellingen → Apple-account → Abonnementen). Voor het ongebruikte deel van een periode wordt geen geld terugbetaald.
• Premium Lifetime — een eenmalige aankoop die Premium ontgrendelt zolang Breath U in de App Store beschikbaar is, op elk apparaat dat met hetzelfde Apple-account is ingelogd.

Prijzen staan in de App en in de App Store in je eigen valuta en kunnen voor nieuwe aankopen wijzigen. Een lanceerprijs geldt alleen voor aankopen tijdens de lanceerperiode. Gebruik Aankopen herstellen op het Premium-scherm om Premium op een nieuw of gewist apparaat te ontgrendelen.

4. Terugbetaling

Aankopen worden verwerkt door Apple. Verzoeken om terugbetaling verlopen via Apple op reportaproblem.apple.com, volgens het terugbetalingsbeleid van Apple. Wij kunnen zelf geen terugbetalingen doen.

5. Geen medisch advies

Breath U biedt begeleide adem-, ademretentie- en koude-oefeningen voor algemeen welzijn. De App is geen medisch hulpmiddel en geeft geen medisch advies, diagnose of behandeling. Retentie-ademhaling en koudeblootstelling brengen echte risico’s met zich mee. Houd nooit je adem in in of bij water, tijdens het rijden of staand, of in een situatie waarin flauwvallen tot letsel kan leiden. Heb je een hart-, long- of bloeddrukaandoening of epilepsie, ben je zwanger, of twijfel je over je gezondheid, overleg dan eerst met je arts. Je gebruikt de App op eigen risico en binnen je eigen grenzen.

6. Leeftijd

Breath U is bedoeld voor volwassenen. Je moet minimaal 16 jaar zijn om de App te gebruiken.

7. Je gegevens

Breath U heeft geen account. Je sessies, uitdagingen en badges blijven op je toestel. Hoe we met informatie omgaan, inclusief Apple Health-gegevens en aankopen, staat in ons Privacybeleid.

8. Toegestaan gebruik

Je mag Breath U gebruiken voor persoonlijke, niet-commerciële doeleinden. Je mag de App of de inhoud ervan niet kopiëren, wijzigen, reverse-engineeren of verspreiden, behalve voor zover de wet of de Standaard-EULA dat toestaat.

9. Beschikbaarheid en wijzigingen

We kunnen functies van de App bijwerken, wijzigen of beëindigen. We streven naar beschikbaarheid, maar kunnen ononderbroken werking niet garanderen. Voor zover de wet dat toestaat is onze aansprakelijkheid beperkt tot het bedrag dat je in de twaalf maanden vóór de claim voor Premium hebt betaald.

10. Toepasselijk recht

Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, onverminderd dwingende consumentenbescherming in het land waar je woont.

11. Wijzigingen van deze voorwaarden

We kunnen deze voorwaarden bijwerken wanneer Breath U verandert of de wet dat vereist. De meest recente versie toont altijd de ingangsdatum bovenaan deze pagina.
